This website is operated by the United Church Bookstore, a ministry of the General Council Office of The United Church of Canada ("The United Church"). By accessing or using the United Church Bookstore website UCRDstore.ca ("Website"), or by purchasing or using products and/or services offered by The United Church or its suppliers through this Website, you acknowledge and accept these terms and conditions of Website use ("Terms"). If you do not agree to these Terms or any changes to these Terms, please immediately discontinue your use of the Website. These Terms do not affect your statutory rights as a purchaser of goods from the Website.

Intellectual Property

The Website and its entire contents, features, and functionality, including all information, software, code, data, text, displays, graphics, photographs, images, video, audio and music (collectively, "Materials") and the design, presentation, layout, selection and arrangement thereof, are proprietary and owned by The United Church, its licensors, or other suppliers of such materials and are protected in all forms by intellectual property laws and rights. Any unauthorized use, reproduction or distribution of any Materials stored or available through the Website may violate copyright, trade-marks, patents or other intellectual property rights or applicable laws and is strictly prohibited. The United Church of Canada and other names, logos, and designs appearing on this Website or in conjunction with the delivery of any products or services on this Website are trade-marks of The United Church or its licensors or other suppliers. You may not use such marks without the prior written permission of the respective owner, as the case may be. All rights not expressly granted are reserved.

Use of Website

The United Church authorizes you to use the Website and Materials for your personal, non-commercial use only provided that: (i) you do not remove any copyright or other proprietary notices contained in the Materials from any copies of the Materials; and (ii) you abide by all applicable laws and comply with all requirements in these Terms, and such additional terms and conditions that may be provided to you during use. Except as permitted by applicable law, you may not modify the Materials in any way or reproduce or publicly display, publish, perform, distribute or otherwise use the Materials or any part thereof for any public or commercial purposes, without the express written consent of the respective owner thereof. Any use of the Website not expressly permitted by these Terms is a breach of these Terms and automatically terminates your authorization to use the Website.

Products and Pricing

The United Church continually updates its product and service offerings on this Website. The United Church reserves the right to revise and/or discontinue such offerings at any time without notice. Prices which may be displayed or advertised on the Website or through any other communications from The United Church do not include shipping fees and applicable sales tax, and are subject to change without notice at The United Church's sole discretion. Colours of products displayed on the Website may not be exactly as shown as colour accuracy may vary depending on computer and browser. The display of products and/or services on the Website does not necessarily constitute an offer by The United Church. Purchases of products available to be purchased on the Website are subject to The United Church Bookstore's Purchase Terms and Conditions which form part of these Terms.

Correction of Errors and Inaccuracies

While The United Church takes care to ensure that information on this Website relating to, among other things, product descriptions, availability, pricing, promotions, offers and shipping charges is accurate, errors, inaccuracies or omissions may occur. The United Church reserves the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information on the Website is inaccurate at any time without prior notice (including after you have submitted your order).

Royalty-free License

You grant to The United Church a non-exclusive, royalty-free, worldwide, perpetual, irrevocable license, with the right to sublicense, to use, reproduce, distribute, transmit, create derivative works of and/or publicly display any content, material, and other information, comments, suggestions or ideas you submit or post to or using the Website in any medium ("User Submissions"). None of the User Submissions you submit to the Website will be subject to any confidentiality by The United Church. You further waive any moral rights or other rights of authorship as a condition of submitting any User Submission. By submitting a User Submission, you declare, represent and warrant that you own or have the necessary rights to submit the User Submission and have the right to grant the licence thereof to us as herein provided, and that the User Submission complies with these Terms.

Prohibited Uses

You agree to comply with all applicable laws while using this Website. In addition to complying with these Terms as modified from time to time, you agree to comply with generally accepted Internet standards and refrain from any abusive use of the Website. You shall not use this Website or the Materials:

for any unlawful purpose;
to promote, or to solicit others to perform or participate in, any unlawful acts;
to violate any applicable laws;
to infringe upon or violate the intellectual property rights of The United Church or others;
to post, transmit, upload, distribute or publish any content that is libelous, seditious, defamatory, blasphemous, fraudulent, invasive of another's privacy, tortious, obscene, sexually explicit or pornographic, abusive, violent, infringing or otherwise illegal, as determined in The United Church's sole discretion
to harass, threaten, abuse, embarrass,or cause harm or distress to any person or entity, including by making any comment or engaging in any conduct that is vulgar, hateful, discriminatory, racially or ethnically offensive, or otherwise objectionable, as determined in The United Church's sole discretion;
to submit false, inaccurate or misleading information;
to impersonate or attempt to impersonate The United Church, an employee or representative of The United Church, or another user, person or entity;
to upload or transmit viruses or any other type of malicious or technologically harmful code;
to collect or track the personal information of others;
to post or transmit any advertising or promotional materials; or
to spam, phish, pharm, pretext, spider, crawl, or scrape.

Further, you are prohibited from attempting to circumvent and from violating the security of this Website or otherwise attempting to interfere with the proper working of this Website or any other user's use and enjoyment of the Website.

Site Monitoring and Enforcement, Suspension, and Termination

We reserve the right, but have no obligation nor any responsibility to any party, to monitor User Submissions. You acknowledge and agree that The United Church, in its sole and absolute discretion, may, without notice to you:

remove or refuse to post on the Website any User Submission for any or no reason;
at all times, take such actions with respect to any User Submission deemed necessary or appropriate, including where The United Church believes that you have violated any of these Terms;
suspend or terminate your use of, or access to this Website, including your account, for any reason, including where The United Church believes that you have violated any of these Terms; and/or
take appropriate legal action, including referral to law enforcement or notifying a harmed party of any illegal or unauthorized use of the Website.

Without limiting the foregoing, we have the right to fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity or other information of anyone posting any User Submissions or engaging in unauthorized activity on or through the Website. You agree that The United Church shall not be liable to you or to any other person as a result of any such action, suspension or termination. If you are unsatisfied with any of these Terms, please discontinue using this Website.

The collection of personal information through this Website is done in accordance with The United Church Bookstore's Privacy Policy, which forms part of these Terms.

Applicable Laws

These Terms shall be governed and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. The courts of the Province of Ontario, or if appropriate, the Federal Court of Canada, shall have exclusive jurisdiction over all disputes relating to these Terms. You agree to submit to the jurisdiction and venue of such courts and that they are appropriate.

Severability

If any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, the unenforceable portion shall be deemed to be severed from these Terms and such determination shall not affect the validity and enforceability of any other provision of these Terms.

The United Church may revise these Terms at any time by updating this Website. Any changes will be effective upon the posting of the revisions on this Website and your use of this Website will be subject to the most current version of the terms and conditions posted on this Website at the time of such use. These Terms, together with the United Church Bookstore's Privacy Policy and any other policies, notices or terms referenced herein or on the Website, constitute the complete and entire agreement between you and The United Church pertaining to the use of this Website and the purchase of products from the United Church Bookstore, and supersede any prior agreement, whether written or oral.

Waiver

The United Church will not be considered to have waived any of its rights or remedies described in these Terms unless the waiver is in writing and signed by The United Church. No delay or omission by The United Church in exercising its rights or remedies will impair or be construed as a waiver of its right to enforce such rights at any time.

Purchase Terms and Conditions

All orders and purchases made through this Website are subject to the UCRDstore.ca Terms and Conditions of Use, The United Church Bookstore's Privacy Policy, and the terms and conditions outlined below ("Purchase Terms"). These Purchase Terms may change from time to time without prior notice. Your purchase of products through this Website constitutes your acceptance of these Purchase Terms.

In order to make a purchase on this Website you must be a registered account holder and you must be the age of majority in your place of residence and will need to provide The United Church with certain personal information so that your order can be processed. You are responsible to ensure the continued accuracy of this information. You agree to be responsible for:

the accuracy of all information that you provide to us;
maintaining the confidentiality of any passwords or other account identifiers that you choose or that are otherwise assigned to you as a result of any registration or purchase made through the Website; and
all activities that occur under such password(s) or account(s). You agree to notify us of any unauthorized use of your password or account of which you are or become aware.

The United Church will not be responsible or liable, directly or indirectly, in any way for any loss or damage of any kind incurred as a result of, or in connection with, your failure to comply with these Purchase Terms.

All prices on this Website are displayed in Canadian currency and all charges will be processed in Canadian currency. Prices which may be displayed or advertised on the Website or through any other communications from The United Church are subject to confirmation, do not include shipping fees and applicable sales tax, and are subject to change without notice at The United Church's sole discretion. Shipping and taxes will be displayed at checkout prior to your final order submission. Merchandise in your "shopping cart" is not reserved. The United Church reserves the right to limit quantities and to refuse to process any order. The United Church may cancel orders and refund customers' payment because of pricing errors, unavailability of inventory or for any other reason. After successfully completing the checkout process you will receive an e-mail confirming that your order has been received. Shipping charges are based on weight and destination. Orders cannot be shipped to addresses outside Canada. Shipping windows are estimates and delivery times are not guaranteed as orders may experience unexpected delays. If for any reason you need to cancel your order, please e-mail our customer service team at info@ucrdstore.ca or phone 1-800-288-7365, and we will make reasonable efforts to accommodate the request. Items cannot be returned without authorization from a United Church Bookstore customer service team member. For return authorization, please e-mail our customer service team at info@ucrdstore.ca or phone 1-800-288-7365. Return requests must be made no later than 30 days after the order date (excluding book displays). Items that have been authorized for return must arrive at our warehouse in saleable condition in order for refund or credit to be issued. Customers are responsible for paying any shipping charges associated with the return. Items that cannot be returned and are final sale include: special orders; yearly church resources, such as calendars and bulletins; periodicals; and any other merchandise marked as "final sale". Merchandise may be purchased using an accepted payment method as displayed at checkout. Your form of payment will be charged at the time of purchase. All orders are subject to security verification. The United Church may in its sole discretion, and without any liability, restrict or terminate your access to this Website at any time without prior notice.
